All back-seat car passengers would have to wear seat belt under bill - New York Post

All back-seat car passengers would be required to wear a seat belt in the Big Apple under a new bill backed by City Hall.

The City Council bill, which is sponsored by Councilman Ydanis Rodriguez (D-Manhattan) at the request of Mayor Bill de Blasio, would make it a traffic infraction punishable by a fine of up to $50 for back-seat passengers 16 years or over caught not wearing a seat belt.

Currently, in New York state, all drivers and front-seat passengers are required to buckle up in both private and for-hire vehicles, but in the back seat, only minors are required to wear a seat belt.

The bill would add a violation for drivers who “fail to ensure safety belt use of their back seat passengers sixteen years or over,” except for TLC-licensed drivers transporting passengers for hire.

Back-seat passengers riding in both for-hire and private vehicles would, however, still face a fine for not buckling up.

The legislation would exempt buses, including school buses, and authorized emergency vehicles, mirroring provisions in state law.

The proposal would also exempt passengers “with a physically disabling condition duly certified by a physician that would prevent safety belt use” and passengers in for-hire cars that lack “a visible, accessible, and working back seat safety belt,” according to the bill.

The legislation was quietly introduced to the City Council back in February, but was raised at a committee hearing Thursday, when city Transportation Commissioner Polly Trottenberg called the bill “a key step the city can take” in the de Blasio administration’s “Vision Zero” goal of eliminating road deaths.

“In analyzing crash reports, we found that a significant number of preventable traffic fatalities in New York City involve lack of seat belt use by rear-seat passengers,” Trottenberg told a joint hearing held by the transportation and public safety committees.

Trottenberg added that “requiring seat belt use in all cases is increasingly a best practice nationally, is strongly supported here in New York by AAA Northeast at the state level, and is a concrete step we should take to achieve Vision Zero,” and noted that 28 states and the District of Columbia now require rear-seat belt use by those 16 and above.

The commissioner said the proposed law “would significantly aid in our public education by letting us promote the message that all passengers, in all vehicles, in all positions must wear their seat belt by law.”
